Terms and conditions
Plain terms for prints, originals and commissions bought from Roosevelt Washington, and for using this site. They are written to be read, not skimmed. If anything is unclear, ask before you buy.

This site, rooseveltwashington.art, and everything sold through it, belong to Roosevelt Washington, an independent artist in Virginia, USA. "I" and "me" mean Roosevelt Washington. "You" means the person using the site or buying from me. By using the site or placing an order you agree to these terms. If you do not agree, please do not buy.
If you are buying as a consumer in the European Union, the United Kingdom or another place with consumer protection laws, nothing in these terms takes away rights that those laws give you and that cannot be waived.
Every piece is made by hand. Original works are drawn or painted by me. Nothing on this site is generated or printed from a machine-made image.
Limited prints. Each print is a reproduction of one of my original works, produced in a limited, numbered set, and signed by me by hand. The edition size for each print is shown on its page. When a set sells out, it is closed. I will not reissue the same print in the same size.
Colour and variation. Screens differ, and paper is not a screen. The colours of a print or an original may differ slightly from what you see online. Because prints are signed and handled by hand, small differences between prints in a set are normal and are part of the work, not a defect.
Originals. An original is one of a kind. Once sold, it is gone. Originals are described as accurately as I can. If you would like more photographs or details before buying, write to me and I will send them.
Prices are in US dollars. The price shown on the product page at the time you order is the price you pay, plus shipping and any tax shown at checkout. Sales tax is charged where the law requires it. If you are outside the United States, your country may charge import duty or tax when the parcel arrives; that is paid by you, not included in the price.
Payment is taken at checkout through Shopify, which accepts major cards and the wallets shown there. I never see your card details. Your order is accepted when I send you an order confirmation. If a price on the site is clearly wrong, I may cancel the order and refund you in full before shipping.
Prints are shipped flat or rolled in a tube, protected for transit, with tracking. I aim to ship within ten working days of your order; originals and framed work can take longer, and I will tell you when. Delivery times after shipping depend on the carrier and your country. I ship to the address you give at checkout, so please check it; a parcel returned because of a wrong address can be re-sent at your cost.
Risk of loss or damage passes to you when the parcel is delivered. If you are a consumer in the EU or UK, risk passes when you, or someone you chose, receive it.
If your work arrives damaged, write to me within 7 days of delivery with photographs of the damage and of the packaging. I will replace the print from the same set if one remains, or refund you in full, including shipping. Please keep the packaging until we have sorted it out, because the carrier may ask to see it.
Prints. If you change your mind, you may return a print within 14 days of delivery. It must be in the condition it arrived in, unframed, unmarked, and packed as it was sent. Write to me first so I can tell you where to send it. You pay the return shipping, and the parcel is your responsibility until it reaches me. Once I have it back in good condition, I refund the price of the print to the card you paid with. The original shipping cost is refunded only where the law requires it.
Originals. Because an original is one of a kind and is often reserved for one buyer, sales of originals are final, except where the work arrives damaged or is not as described, or where consumer law gives you a right of return.
Commissions. A commission is made to your request and for you alone. Once work has started it cannot be returned and the deposit cannot be refunded, as explained below.
EU and UK consumers. You have a legal right to cancel an order for a print within 14 days of receiving it, for any reason, by telling me in writing. The same conditions on condition, packing and return shipping apply. This right does not apply to commissions or other work made to your specification, which the law excludes.
Refunds are sent within 14 days of my receiving the returned work or, for cancelled orders not yet shipped, within 14 days of your cancelling.
If you ask me to make a work for you, we agree the subject, size, medium, price and a rough timeline in writing (email is fine) before I start. Then:
All artwork, images, text and the design of this site are copyright of Roosevelt Washington. When you buy a print or an original, you buy the physical object. You do not buy the copyright or any right to reproduce the image. You may not copy, scan, photograph for reproduction, print, sell copies of, make merchandise from, or use the image in any publication, product, or digital work, and you may not use it to train or feed any artificial intelligence or image-generation system, without my written permission.
You may photograph a work you own for personal, non-commercial use, such as showing it in your home on social media, and I appreciate a credit. You may resell a print or original you own; the copyright stays with me. Galleries, publications and licensing enquiries are welcome by email.
My name, signature and likeness may not be used to suggest that I endorse any product, service or cause.
Fine art prints and original works on paper last for generations when they are treated well. Keep them out of direct sunlight, away from damp, and frame them behind glass with acid-free materials. I am not responsible for fading, warping or other damage caused by sunlight, humidity, heat, framing, cleaning or handling after delivery.
I try to keep the site accurate and available, but I do not promise that it will always be free of errors or interruptions. Descriptions, edition sizes and prices may be corrected at any time. Links to other sites (Instagram, Shopify, messaging apps) are provided for convenience; those sites have their own terms and I am not responsible for them. You may not use this site in any way that breaks the law, harms the site or copies its content.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Beyond that, my total liability to you for any order, whatever the cause, is limited to the amount you paid for that order. I am not liable for indirect or consequential losses, such as lost profits, or for losses I could not reasonably have foreseen when you ordered. Where the law lets me, the work is sold as described and without other warranties.
I am not responsible for delay or failure caused by things outside my reasonable control, such as carrier disruption, severe weather, illness, or supplier failure. I will tell you if that happens and, if the delay is long, you may cancel and receive a full refund of anything not yet shipped.
These terms are governed by the laws of the Commonwealth of Virginia, United States, and any dispute will be heard by the courts of Virginia, except that if you are a consumer living elsewhere, you keep the protection of the mandatory laws of your own country and the right to bring a claim where you live. If something goes wrong, please write to me first. Almost everything can be sorted out with a conversation.
I may update these terms from time to time. The date at the top shows the current version. The terms that apply to your order are the ones in force when you placed it.
